These Terms of Use are dictated by the laws of the State of Florida, USA, regardless of conflicting legal principles. You hereby consent to resolving any disputes or claims between you and Realcountdown.com exclusively through conclusive and binding arbitration, as opposed to pursuing them in a court, with the exception that you may take claims to a small claims court if they meet the criteria. The Federal Arbitration Act will oversee how this provision is interpreted and enforced. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its rules and procedures, with modifications outlined in this provision. The AAA's rules can be found at www.adr.org, and you can initiate arbitration proceedings using a form available on the AAA's website at https://www.adr.org/. The arbitration will take place in the county where you reside or another mutually agreed location. If the relief sought is $10,000 or less, you and Realcountdown.com may choose to conduct the arbitration via telephone or based solely on written submissions, which decision will be binding, unless the arbitrator deems an in-person hearing necessary under the circumstances. Attendance at an in-person hearing can be made by telephone for you and/or Realcountdown.com, unless the arbitrator specifies otherwise. The arbitrator's decision is final and binding, and a judgment based on the arbitrator's award can be entered in a court with jurisdiction. All filing, administration, and arbitrator fees will be governed by the AAA's rules, unless stated otherwise in this provision. If a court determines that any part of this provision is invalid or unenforceable, the other parts of this provision will still apply. Unauthorized access or use of the Realcountdown.com Network is not allowed in any jurisdiction that does not uphold all the terms and conditions, including this provision.
Additionally, you acknowledge that no partnership, employment, joint venture, or agency relationship is established between you and Realcountdown.com due to these Terms of Use or your use of the Realcountdown.com Network.
